Gardeners Millwall Service Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Millwall provides gardening and related services. By booking or accepting any service from Gardeners Millwall, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Client means the person, company or organisation that requests or receives services from Gardeners Millwall.
Services means any gardening, garden maintenance, garden clearance, planting, lawn care, hedge care, soft landscaping, green waste removal and other related work provided by Gardeners Millwall.
Agreement means the contract between Gardeners Millwall and the Client comprising these Terms and Conditions and any written confirmation of booking, quotation, or service schedule.
Site means the garden, land, or property at which the Services are to be provided.
2. Scope of Services
Gardeners Millwall provides domestic and commercial gardening services within its stated service area in the United Kingdom. The precise scope of work for each visit or project will be set out in a quotation, booking confirmation or service schedule agreed with the Client.
Any description of services, photographs or examples are illustrative only. Gardeners Millwall will provide services with reasonable skill and care and in accordance with applicable industry standards, subject to weather, seasonal factors and site conditions.
Gardeners Millwall reserves the right to refuse or discontinue any service where it considers the Site unsafe, where access is restricted, or where the requested work is illegal or contrary to environmental regulations.
3. Booking Process
3.1 Booking requests
Clients may request a booking or quotation by contacting Gardeners Millwall and providing accurate details of the Site, the type of services required, preferred dates, and any access or parking information.
All bookings are subject to availability. Gardeners Millwall is not obligated to accept any booking request.
3.2 Quotations
Where appropriate, Gardeners Millwall may provide a quotation based on information supplied by the Client or following a site visit. Quotations are normally estimates and may be subject to change if the information provided is incomplete or inaccurate, or if Site conditions differ from those reasonably anticipated.
Unless otherwise stated, quotations are valid for a limited period from the date of issue. After this period, Gardeners Millwall may revise or withdraw the quotation.
3.3 Confirmation of booking
A booking is only confirmed when Gardeners Millwall issues a booking confirmation or otherwise expressly accepts the Client's request. At that point, an Agreement arises between Gardeners Millwall and the Client on these Terms and Conditions.
Gardeners Millwall may require a deposit or pre-payment as a condition of confirming a booking, particularly for larger or multi-day projects.
4. Access and Client Obligations
The Client must ensure that Gardeners Millwall and its personnel have safe and reasonable access to the Site at the agreed dates and times. This includes providing access to gates, communal areas and any necessary entry codes or passes.
The Client must ensure that pets, children and other occupants are kept clear of the working area and that the Site is reasonably clear of hazards such as excrement, sharp objects, or unsafe structures. Gardeners Millwall may refuse to work or may charge additional fees if extra cleaning or safety measures are required.
The Client is responsible for informing Gardeners Millwall of any underground services, cables, pipes, sprinkler systems, or other hidden hazards on the Site. Gardeners Millwall is not responsible for damage to any item that it could not reasonably have identified in advance.
5. Pricing and Payments
5.1 Prices
Prices may be quoted as hourly rates, fixed fees, or project-based estimates and may include or exclude materials, waste removal, parking and congestion charges, as specified in the quotation or booking confirmation.
Gardeners Millwall reserves the right to adjust rates from time to time. Any change to agreed rates will not affect a confirmed booking already accepted, unless additional services are requested or the scope materially changes.
5.2 Payment terms
Unless otherwise agreed, payment for one-off services is due immediately upon completion of the work. For regular maintenance services, payment terms will be set out in the service schedule or invoice.
Gardeners Millwall may require a deposit or full pre-payment before commencing work, particularly for large projects, materials-intensive work, or where bespoke items are required.
Payments must be made in the currency and via the methods specified on the invoice or in the booking confirmation. The Client is responsible for any bank charges or transaction fees associated with payment.
5.3 Late or non-payment
If payment is not received by the due date, Gardeners Millwall may, at its discretion, suspend further services, charge interest on overdue sums at the maximum rate permitted by law, and recover reasonable costs incurred in pursuing outstanding payments.
Ownership of any materials supplied by Gardeners Millwall does not pass to the Client until full payment for those materials and related services has been received.
6. Amendments and Cancellations
6.1 Client amendments
If the Client wishes to change the date, time, or scope of a booking, they must contact Gardeners Millwall as early as possible. All changes are subject to availability and may result in revised pricing.
Where changes materially alter the scope of work, Gardeners Millwall may issue an updated quotation and require acceptance before proceeding.
6.2 Client cancellations
The Client may cancel a booking by providing notice to Gardeners Millwall. Gardeners Millwall may apply cancellation charges, particularly where short notice is given or costs have already been incurred for materials or preparation.
Details of any standard cancellation periods and fees will be set out in the booking confirmation or service schedule. As a general guideline, cancellations with short notice before the scheduled visit may incur part or full charges to cover lost time and costs.
6.3 Cancellations by Gardeners Millwall
Gardeners Millwall reserves the right to cancel or reschedule any booking due to adverse weather, illness, staff shortages, equipment failure, access problems, safety concerns, or other circumstances beyond its reasonable control.
In such cases, Gardeners Millwall will aim to provide as much notice as practicable and offer alternative dates where possible. Gardeners Millwall will not be liable for any loss arising from such cancellation or rescheduling, except to refund any pre-payments for services not provided.
7. Waste Handling and Environmental Regulations
7.1 Green waste
Gardeners Millwall will handle green waste such as grass cuttings, leaves, small branches and plant material in accordance with applicable UK waste and environmental regulations.
Where possible and agreed, green waste may be left on Site for composting or disposal by the Client. If the Client requires removal of green waste, this may incur additional charges, which will be specified in the quotation or invoice.
7.2 Non-green waste
Gardeners Millwall is not a general waste carrier and may not remove certain types of waste, including but not limited to soil in large quantities, rubble, construction waste, hazardous materials, contaminated soil, or household refuse, unless explicitly agreed and properly licensed.
The Client is responsible for arranging appropriate disposal of any non-green waste, unless otherwise agreed in writing. Gardeners Millwall will comply with all applicable duties of care in relation to any waste it does collect and transport.
7.3 Regulatory compliance
Gardeners Millwall will use reasonable endeavours to comply with relevant environmental and waste regulations when providing services. The Client must not request any action that would breach such regulations or require unlawful disposal of waste.
8. Health, Safety and Site Conditions
Gardeners Millwall takes health and safety seriously and expects Clients to cooperate in ensuring a safe working environment.
Gardeners Millwall may refuse to undertake work in areas it deems unsafe, including steep slopes, unstable structures, or areas affected by pests or hazardous substances.
The Client should inform Gardeners Millwall of any health and safety issues known at the Site, including previous use of chemicals, pesticides, or any structural concerns that may affect the safe provision of services.
9. Liability and Limitations
9.1 Standard of service
Gardeners Millwall will exercise reasonable skill and care in providing the Services. If the Client believes the Services have not been performed to a reasonable standard, they must notify Gardeners Millwall promptly with clear details and, where possible, photographs.
Gardeners Millwall will consider any such concerns and may, at its discretion, offer to rectify issues where it is responsible and where notification is received within a reasonable time after completion of the relevant work.
9.2 Limitation of liability
To the fullest extent permitted by law, Gardeners Millwall is not liable for any indirect, consequential, or economic loss, including loss of profit, loss of enjoyment, or loss of opportunity, arising out of or in connection with the Services or these Terms and Conditions.
Gardeners Millwall's total liability for any claim arising under or in relation to the Agreement is limited to the amount paid or payable by the Client for the specific Services giving rise to the claim.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
9.3 Exclusions
Gardeners Millwall is not liable for damage or loss resulting from pre-existing defects, poor materials supplied by the Client, misuse or neglect by the Client, or events beyond Gardeners Millwall's reasonable control, including extreme weather, pests, disease, or acts of third parties.
Gardeners Millwall does not guarantee the future growth or performance of plants, lawns or trees, as these are dependent on environmental conditions and ongoing care by the Client.
10. Insurance
Gardeners Millwall will maintain appropriate public liability insurance for the provision of its Services, in line with industry practice. Evidence of insurance may be provided on request.
The Client is responsible for ensuring that their own buildings, contents, and other relevant insurance policies adequately cover any gardening or maintenance work at the Site, particularly where valuable items or structures are present.
11. Intellectual Property and Photography
Any plans, designs, planting schemes or other creative materials produced by Gardeners Millwall remain its intellectual property unless otherwise agreed in writing. The Client is granted a non-exclusive licence to use such materials solely for the purpose of implementing and maintaining the garden at the Site.
Gardeners Millwall may take photographs of the Site before, during and after the work for records, insurance and training purposes. With the Client's consent where required, such photographs may also be used for marketing, provided that the Client's identity and address are not disclosed without permission.
12. Complaints and Dispute Resolution
If the Client is dissatisfied with any aspect of the Services, they should raise the matter directly with Gardeners Millwall as soon as possible so that it can be investigated and, where appropriate, rectified.
Both parties agree to attempt to resolve disputes amicably and in good faith before considering formal legal action.
13. Changes to Terms and Conditions
Gardeners Millwall may update these Terms and Conditions from time to time. The version in force at the time of confirmation of a booking will apply to that booking. Clients are encouraged to review the current Terms and Conditions before making a booking.
14. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, are governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, subject to any mandatory rights the Client may have under consumer legislation.
15. General Provisions
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No waiver of any right or remedy by Gardeners Millwall shall be effective unless in writing, and any failure to exercise or delay in exercising a right or remedy shall not constitute a waiver of that or any other right or remedy.
The Agreement is between Gardeners Millwall and the Client and is not intended to confer any rights on any third party.
These Terms and Conditions, together with any quotation, booking confirmation or service schedule, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.
